Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Valley Rush mobile applications and related services (together, the "Platform"). The Platform is owned and operated by Valley Rush Private Limited, a company incorporated under the Companies Act, 2013 (CIN: —), with its registered office at Srinagar, Jammu and Kashmir, India ("Valley Rush", "we", "us" or "our").
By creating an account, placing an order or otherwise using the Platform, you agree to these Terms, our Privacy Policy, our Cancellation, Returns & Refund Policy and our Shipping & Delivery Policy, each of which forms part of these Terms. If you do not agree, please do not use the Platform.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
1. Our role: a marketplace
Valley Rush is an online marketplace. Products listed on the Platform are sold by independent, verified sellers ("Sellers"), not by Valley Rush unless a listing expressly says it is sold by us. When you buy a product, the contract of sale is directly between you and the Seller. We provide the technology, payment collection, customer support and, where shown, delivery through our delivery partners.
Each product page shows the name of the Seller. Seller details, including the Seller's address and contact information, are available on request through Help & Support, as required by the Consumer Protection (E-Commerce) Rules, 2020.
2. Eligibility and your account
- You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. If you are under 18, you may use the Platform only with the involvement of a parent or guardian.
- You must provide accurate, current and complete information and keep it updated. Your mobile number or email is verified with a one-time password (OTP).
- You are responsible for all activity under your account and for keeping your password and OTPs confidential. Tell us immediately at support@valleyrush.shop if you suspect unauthorised use.
- One person may hold only one customer account. We may suspend or close accounts that are fake, duplicated, used for fraud or that breach these Terms.
3. Products, prices and availability
- Product descriptions, images, specifications and prices are provided by Sellers. We work to keep them accurate but do not warrant that every description is complete or error-free. Images are for illustration; actual packaging may vary.
- All prices are in Indian Rupees and include applicable GST unless stated otherwise. Delivery fees, any surge or convenience fee and discounts are shown separately at checkout before you pay.
- Each listing shows the maximum retail price (MRP), the selling price and, where applicable, the country of origin, as required by the Legal Metrology (Packaged Commodities) Rules, 2011.
- Availability is not guaranteed until the Seller accepts your order. If a product becomes unavailable or a price was displayed incorrectly, the Seller may cancel the order and any amount you paid will be refunded in full.
4. Orders and contract formation
- Placing an order is an offer to buy. The contract is formed when the Seller accepts your order; you will see the status change to "Confirmed" in the app.
- A single checkout may contain products from more than one Seller. In that case it is split into separate orders, one per Seller, each with its own delivery, fees and status.
- We may limit quantities, refuse or cancel orders that appear fraudulent, are placed for resale in commercial quantities, or that breach these Terms.
5. Payments
- You can pay online (UPI, debit and credit cards, net banking, wallets) through our payment partner Cashfree Payments India Private Limited, an RBI-authorised payment aggregator, or by Cash on Delivery (COD) where available.
- Card and bank details are entered on the payment partner's secure page; Valley Rush does not store your full card number, CVV or UPI PIN.
- COD may be unavailable for some orders, locations or order values. COD orders must be paid in full at the time of delivery, in cash or by scanning the UPI QR shown by our delivery partner.
- If an online payment is debited but the order is not confirmed, the amount is automatically refunded to the original payment method, normally within 5–7 working days.
6. Coupons and offers
Coupons and offers are subject to their stated terms (minimum order value, validity, maximum discount and usage limits). They have no cash value, cannot be combined unless stated and may be withdrawn if misused. If an order is cancelled or partly refunded, the refund reflects the amount you actually paid.
7. Delivery
Delivery timelines, fees and areas are described in our Shipping & Delivery Policy. Estimated times are indicative and may be affected by weather, traffic, local restrictions or Seller preparation time.
8. Cancellations, returns and refunds
You may cancel an order, and request a return or refund, as set out in our Cancellation, Returns & Refund Policy.
9. Your conduct
You agree not to:
- use the Platform for any unlawful, fraudulent or abusive purpose, or to place orders you do not intend to accept;
- post reviews or content that is false, defamatory, obscene, hateful, infringing or that violates Rule 3(1)(b) of the IT Rules, 2021;
- harass, threaten or abuse Sellers, delivery partners or our staff;
- attempt to gain unauthorised access to, scrape, reverse-engineer, overload or disrupt the Platform;
- misuse coupons, referral benefits, refunds or COD.
We may remove content, cancel orders, withhold benefits or suspend accounts that breach this section.
10. Reviews and content you submit
Reviews must reflect your genuine experience with a product you bought. By submitting content, you grant Valley Rush a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with the Platform. We may moderate or remove content that breaches these Terms.
11. Intellectual property
The Platform, the Valley Rush name and logo, and all software, design and content we provide are owned by or licensed to Valley Rush Private Limited and are protected by law. You may use them only to shop on the Platform for personal, non-commercial purposes. Product names and brands belong to their respective owners.
If you believe content on the Platform infringes your rights, write to grievance@valleyrush.shop with details of the work, the infringing listing and your authority to act; we will act on valid notices as required by law.
12. Disclaimers
The Platform is provided on an "as is" and "as available" basis. Product warranties, where offered, are provided by the Seller or the manufacturer, not by Valley Rush. To the extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose for products sold by Sellers. Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019.
13. Limitation of liability
To the maximum extent permitted by law, Valley Rush is not liable for indirect, incidental, special or consequential losses. Our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability that cannot be limited by law, including for fraud or for deficiency in our own services.
14. Indemnity
You agree to indemnify Valley Rush Private Limited, its directors, employees and delivery partners against claims, losses and costs arising from your breach of these Terms or misuse of the Platform.
15. Suspension and termination
You may stop using the Platform and delete your account at any time from Settings → Delete account (see our Account Deletion page). We may suspend or terminate access for breach of these Terms, for suspected fraud or where required by law. Orders already placed remain subject to these Terms.
16. Grievances
If you have a complaint, contact Help & Support in the app or write to support@valleyrush.shop. If it is not resolved, you may escalate to our Grievance Officer as described in our Grievance Redressal policy. We acknowledge complaints within 48 hours and aim to resolve them within one month of receipt.
17. Governing law and disputes
These Terms are governed by the laws of India. Subject to your rights under the Consumer Protection Act, 2019 to approach a consumer commission, courts at Srinagar, Jammu and Kashmir shall have jurisdiction over disputes arising out of these Terms.
18. Changes to these Terms
We may update these Terms from time to time. We will show the updated date at the top and, for material changes, notify you in the app. Continuing to use the Platform after the change means you accept the updated Terms.
